Currently, Victoria has requirements under the Occupational Health and Safety Act 2004 (Vic), although they are moving to join all other states in the national workplace safety framework. Regulation 4.3.20 outlines the requirement for an Asbestos Survey to be carried out to determine the existence and level of harm of asbestos.
Where Asbestos is found, there is also a requirement to keep an onsite Asbestos Register available to all employees, contractors. Further, the Victorian Compliance Code for Asbestos outlines as best practice an Asbestos Management Plan. These are mandated under the national code.
The penalties for non-compliance are severe with the maximum penalty of $30,000. However, if your failure to comply leads to a serious illness, you could face fines of $3 million, 5 years prison and/or damages from civil litigation.
